This information is utilized to provide mental health services, process billing, manage appointment scheduling, and ensure compliance with regulatory requirements.

3. HIPAA Notice of Privacy Practices (PHI Protection)

Bluebird Therapy Center is required by law to maintain the privacy of your Protected Health Information (PHI) and to provide you with this notice of our legal duties. We adhere to the Health Insurance Portability and Accountability Act (HIPAA) and, where applicable, federal regulations regarding alcohol and drug treatment records (42 CFR Part 2).

Accounting of Disclosures: Request a list of certain disclosures we have made of your PHI over the past six years. You will not be charged for your first request in any 12-month period; subsequent requests may incur a reasonable, cost-based fee.

Right to a Paper Copy: Obtain a paper copy of this Notice of Privacy Practices upon request.

4. SMS Messaging & TCPA Compliance

Bluebird Therapy Center complies with the Telephone Consumer Protection Act (TCPA) for all text communications.

Explicit Data Protection Statement: Bluebird therapy center DOES NOT share customer opt-in information, including phone numbers and consent records, with any affiliates or third parties for marketing or promotional purposes.

Consent Mechanism: Express written consent is obtained via booking forms for appointment reminders and service updates. Consent to receive SMS messages is not a condition of purchase.

Opt-Out/Support Instructions: Reply STOP to cancel SMS notifications at any time. Reply HELP for assistance.

Message Disclaimers: Message frequency varies based on interactions. Standard message and data rates may apply. Carriers are not liable for delayed or undelivered messages.

5. Data Sharing and Third Parties

We do not sell, rent, or trade your personal information. Information sharing is limited to:

Service Providers: Third-party vendors who assist in operations (e.g., billing, hosting). Subcontractors in support services, such as customer service, may have access to necessary data under strict confidentiality.

Healthcare Professionals: Providers involved in your care, typically requiring your consent.

Legal Authorities: When required to comply with law or protect the rights and safety of the center.

The exclusion for SMS opt-in data applies to all third-party sharing categories except for those providing the actual text messaging service or essential support subcontractors.

We implement administrative, technical, and physical safeguards—including encryption of sensitive data—to protect your information. Data is retained only as long as necessary for service provision or legal compliance.

Part II: Terms of Service

1. Acceptance of Terms

By accessing the Bluebird Therapy Center website or utilizing our services, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree to these terms, you are prohibited from using the site.

2. Account Responsibilities

Users are responsible for maintaining the security and confidentiality of their account credentials. You must provide accurate and truthful information. We reserve the right to terminate accounts for illegal activity or policy violations.

3. Sale of Services and Payments

Services: Bluebird Therapy Center provides mental health services, including therapy sessions and consultations.

Revisions and Errata: All information, descriptions, or images provided about our services are as accurate as possible. However, we are not legally bound by such information as we cannot guarantee the absolute accuracy of all descriptions. Materials appearing on the site may include technical or typographical errors; we provide all materials "as is."

Payments: Payments are processed via secure third-party processors adhering to PCI-DSS standards. We accept Credit/Debit/Direct Debit.

Refund Policy: We offer NO REFUNDS once the service is completed. We reserve the right to modify or cancel orders as necessary, providing a refund only if payment was processed for a service we cancelled.

4. Intellectual Property

All content on the site—including logos, text, images, and documents—is the exclusive property of Bluebird Therapy Center.

Grant of License: Permission is granted to temporarily download one copy of the materials for personal, non-commercial transitory viewing only. This is a license, not a transfer of title. You may not modify the materials, use them for commercial display, or remove any proprietary notations.

5. Limitation of Liability and Indemnity
